THE MARRIAGE MATES™ DMCA POLICY
1. Copyright Policy
The Marriage Mates LLC respects the intellectual property rights of others and expects users of The Marriage Mates™ website, digital products, services, and other online offerings to do the same. This policy describes the process for reporting alleged copyright infringement and, where applicable, responding to removal or disabling of material under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.
The Marriage Mates LLC may remove or disable access to material that it reasonably believes may infringe copyright, and may take other appropriate action consistent with applicable law, its Terms of Service, and this policy. Processing a notice or counter-notification does not constitute a determination by The Marriage Mates LLC regarding copyright ownership, infringement, or the merits of any dispute.
2. Notice of Claimed Copyright Infringement
If you believe that material available through a service operated by The Marriage Mates LLC infringes a copyright that you own or are authorized to enforce, send a written notification to the Designated DMCA Agent identified below. To be effective under 17 U.S.C. § 512(c)(3), the notification should include substantially the following:

A physical or electronic signature of the copyright owner or a person authorized to act on the owner’s behalf.

Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works are covered by one notification, a representative list of those works.

Identification of the material claimed to be infringing or the subject of infringing activity, together with information reasonably sufficient to permit The Marriage Mates LLC to locate the material, such as the specific URL or other precise location.

Information reasonably sufficient to permit The Marriage Mates LLC to contact the complaining party, such as a name, mailing address, telephone number, and email address.

A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, the owner’s agent, or the law.

A statement that the information in the notification is accurate and, under penalty of perjury, that the complaining party is the copyright owner or is authorized to act on behalf of the copyright owner.
A notice that does not substantially comply with the statutory requirements may be ineffective. The Marriage Mates LLC may request additional information reasonably necessary to evaluate or process a notice.
3. Response to a Valid Notice
When The Marriage Mates LLC receives a substantially compliant notice concerning material hosted or controlled through an applicable service, it may act expeditiously to remove or disable access to the identified material when required or appropriate. Where applicable, The Marriage Mates LLC may notify the affected subscriber or user and provide information about the counter-notification process.
The Marriage Mates LLC reserves the right to remove or disable access to material at any time when permitted by its Terms of Service or applicable law, including circumstances independent of the DMCA process.
4. Counter-Notification
If material you submitted was removed or access to it was disabled as a result of a DMCA notice and you believe the removal or disabling resulted from mistake or misidentification, you may send a written counter- notification to the Designated DMCA Agent. A counter-notification under 17 U.S.C. § 512(g) should include substantially the following:

9. A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification of the material.

Your name, address, and telephone number, together with a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located, or, if your address is outside the United States, for any judicial district in which The Marriage Mates LLC may be found, and that you will accept service of process from the person who submitted the original infringement notice or that person’s agent.
5. Restoration Following a Counter-Notification
When The Marriage Mates LLC receives a substantially compliant counter-notification, it may provide a copy to the person who submitted the original notice and inform that person that the removed material may be replaced or access restored. Subject to 17 U.S.C. § 512(g) and other applicable law, The Marriage Mates LLC may replace the material or restore access not less than 10 nor more than 14 business days after receipt of the counter-notification unless the Designated DMCA Agent first receives notice that the original complaining party has filed an action seeking a court order to restrain the subscriber or user from engaging in infringing activity relating to the material.
6. Repeat Infringer Policy
In appropriate circumstances, The Marriage Mates LLC may terminate or restrict the accounts or access of users or subscribers who are repeat copyright infringers. The Marriage Mates LLC reserves reasonable discretion in implementing this policy consistent with applicable law, the circumstances presented, and its Terms of Service.
7. Misrepresentations and Abuse of the DMCA Process
DMCA notices and counter-notifications are legal communications. Under 17 U.S.C. § 512(f), a person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys’ fees, as provided by law. Parties should consider copyright exceptions and limitations, including fair use where applicable, before submitting a notice.
The Marriage Mates LLC may reject, disregard, or seek clarification of communications that are fraudulent, abusive, materially incomplete, unrelated to copyright, or otherwise do not provide information reasonably sufficient to process the request.
8. No Legal Determination or Legal Advice
The Marriage Mates LLC does not act as a court and does not adjudicate copyright ownership or infringement disputes through the DMCA process. Removal, disabling, restoration, or other action taken in response to a notice or counter-notification does not constitute an admission, finding, or legal determination by The Marriage Mates LLC. This policy is provided for informational and procedural purposes and is not legal advice to any person submitting or responding to a claim.
9. Designated DMCA Agent
Notices of claimed copyright infringement and counter-notifications should be directed to the Designated DMCA Agent. The agent information below must be completed and, if The Marriage Mates LLC seeks to comply with 17 U.S.C. § 512(c)(2), the designation must be registered with the U.S. Copyright Office and kept current before this section is published as a completed designation.
